Terms and Conditions
These Terms are intended to operate together with the Privacy Policy, Shipping & Delivery Policy, and Return, Exchange, Cancellation & Refund Policy. Product-specific written terms in an accepted Order Confirmation prevail only for that product and only to the extent they are not inconsistent with Applicable Law.
1. Definitions and interpretation
In these Terms, "TT", "we", "us" and "our" mean M/s GOODVIEW FASHION PVT. LTD, operating the Tarun Tahiliani online storefront. "Customer", "you" and "your" mean the person placing or receiving an Order. "Website" means www.taruntahiliani.com and any official online storefront identified by TT. "Applicable Law" includes all laws, rules, regulations and binding orders applicable to the transaction, including applicable consumer-protection, e-commerce, tax, legal-metrology, information-technology, privacy and payment laws.
| Defined term | Meaning |
|---|---|
| Ready-to-Ship | A product offered from existing inventory and ordinarily available for dispatch after final stock, fraud and quality verification. |
| Made-to-Order / MTO | A product manufactured or finished after Order acceptance, including a standard-size product produced on demand. |
| Customised / Bespoke | A product manufactured, altered, personalised or otherwise committed to customer-specific measurements, specifications, monograms, colour/material choices or approved design changes. |
| Order Confirmation | The automated order-confirmation email sent by TT following successful placement of an Order on the Website, recording the relevant Order details and constituting TT's acceptance under Clause 4. |
| Business Day | A day other than Sunday or a public holiday at the relevant TT office in India, unless the context requires otherwise. |
2. Eligibility, account use and authority
You may use the Website and place an Order only if you are legally competent to contract or act through a lawful guardian/authorised representative. Account information must be accurate, current and complete. You must keep credentials confidential and promptly notify TT of suspected compromise. TT may suspend access where it reasonably suspects fraud, impersonation, automated abuse, unlawful activity or account compromise, provided any consumer rights relating to an accepted Order remain unaffected.
3. Product presentation, craftsmanship and tolerances
TT takes reasonable care to present product descriptions, composition, components, colour, size and imagery accurately. Luxury and couture products may involve hand embroidery, hand finishing, natural fibres, artisanal dyeing, printing or other manual processes. Owing to the nature of luxury and couture craftsmanship, including hand embroidery, hand finishing, natural fibres, artisanal dyeing, printing and other manual processes, variations in weave, texture, embroidery placement, print alignment, shade, finish and other handcrafted details may occur. Such variations will not, by themselves, constitute a manufacturing defect where the product, considered as a whole, substantially conforms to the applicable description and any customer-approved specification.
4. Order placement, acknowledgement and contract formation
Placing an Order is an offer to purchase. An automated acknowledgement of receipt or payment authorisation is not, by itself, acceptance. TT accepts the Order when it issues an Order Confirmation or otherwise expressly communicates acceptance through the order workflow. Before acceptance, TT may decline an Order for genuine reasons including stock/material unavailability, an obvious pricing or description error, payment failure, suspected fraud, destination restrictions, serviceability constraints or inability to perform a requested customisation.
If TT has captured payment for an Order it does not accept, TT will initiate a full refund of the amount collected for that Order to the original payment method, subject to payment-provider processing time.
5. Order specification, customer approval and hierarchy of records
For MTO and Customised/Bespoke Orders, the accepted Order Specification is a material part of the contract. It should record, as applicable, style/SKU, product category, size/measurements and measurement source, colour/material, components, customisation, agreed reference images or swatches, price and charges, production/dispatch estimate, delivery destination and any expressly guaranteed commitment.
Where a customer approves a digital or written order sheet, measurement chart, alteration note, design rendering, swatch or other specification, the approved record will be used to assess conformity. General website imagery does not override a later customer-specific approved specification.
6. Made-to-Order, Customised/Bespoke Orders and Order Lock
Before Order Lock, TT may accept a customer request to cancel or change an MTO/Customised/Bespoke Order, subject to operational feasibility. After Order Lock, the Order is ordinarily non-cancellable and non-changeable for a change-of-mind reason because TT has committed resources specifically to that customer. This restriction does not limit remedies for a qualifying defect, wrong supply, material non-conformity, TT-attributable failure or any non-waivable statutory right.
Any additional charge, revised specification and revised timeline must be disclosed and affirmatively accepted before the change is undertaken.
7. Measurements, fittings, approvals and customer-caused delay
Where the Customer supplies measurements, the Customer must ensure they are complete, accurate, in the requested units and taken using the stated method. TT is not responsible for a fit issue caused solely by inaccurate or incomplete customer-supplied measurements where the finished product conforms to the approved specification and applicable production tolerance.
If required measurements, approvals, fitting feedback, customs/KYC information or other customer inputs are outstanding, TT may suspend production or dispatch and the affected timeline will be correspondingly extended. If essential inputs remain outstanding for six months, TT may issue a final written reminder giving at least 15 days to provide them. If they remain outstanding, TT may close the dormant Order. Any refund or amount retained will be determined by Applicable Law, the actual production stage and documented irreversible customer-specific work/cost already incurred; TT will not impose an undisclosed punitive forfeiture.
8. Event dates and occasion-based purchases
A wedding, event, travel or occasion date provided by a Customer is informational unless TT expressly confirms in writing that delivery by that date is guaranteed. A production or dispatch estimate is not converted into a guaranteed event-date commitment merely because TT is informed of the occasion. TT will nevertheless use reasonable efforts to communicate material delay.
9. Prices, MRP, taxes and charges
For India deliveries, prices displayed as MRP will be inclusive of applicable taxes to the extent required by law. Any shipping, alteration, expedited service, customization or other customer-payable charge will be disclosed before payment. The final checkout page will display the total amount payable.
For international Orders, products are supplied on a duties-paid basis, and the prices displayed at checkout include applicable destination customs duties, import taxes and import VAT/GST payable on importation that TT has undertaken to bear. TT will arrange for the payment of these included charges through its authorised shipping or logistics partners, and the Customer will not be required to pay them again upon delivery. Prices may change prospectively; an accepted Order will not be repriced merely because the Website price later changes, except where correction is required by law or an obvious error is identified before acceptance.
10. Payment, verification and fraud prevention
Payments are processed through authorized third-party payment service providers. TT may conduct proportionate fraud, sanctions, address and payment-verification checks and may request reasonable supporting information for a high-risk or disputed transaction. TT does not guarantee that a bank or payment provider will approve a transaction and is not responsible for a decline caused solely by the provider.
11. Customer cancellation
Ready-to-Ship Orders may be cancelled before dispatch where the order workflow permits or Customer Care confirms cancellation. After dispatch, cancellation as a shipment may not be possible; any available return right is governed by the Return, Exchange, Cancellation & Refund Policy. MTO and Customised/Bespoke Orders are governed by the Order Lock rules above and the Return Policy.
12. Cancellation by TT and inventory/material unavailability
TT may cancel an Order it cannot lawfully or reasonably fulfil, including genuine stock/material unavailability, inability to execute an approved customisation, payment/fraud concerns, export/import restrictions or a material error identified before acceptance. TT will notify the Customer and refund the amount collected for the affected item together with any TT-collected shipping/freight attributable to it, unless the Customer voluntarily accepts an alternative product, revised specification or revised timeline.
13. Shipping, delivery, title and risk
Production, dispatch, transit, customs and delivery are separate stages. Product-specific estimates and the Shipping & Delivery Policy apply. Risk in the product passes on physical delivery to the Customer or a person authorised by the Customer at the delivery address. A delivery OTP, signature, carrier scan, proof-of-delivery image or equivalent logistics record may be used as prima facie evidence of delivery, subject to contrary evidence and Applicable Law.
14. Failed delivery, return-to-origin and customer-caused costs
The Customer must provide a complete serviceable address, accurate contact details and, where applicable, destination customs/KYC information. If delivery fails because of an incorrect address, repeated non-availability, unjustified refusal, or failure to pay clearly disclosed destination duties/taxes, TT may recover the actual reasonable and legally recoverable re-shipping/return-to-origin cost before re-dispatch. No customer-caused deduction will apply where the failure is attributable to TT or the carrier.
15. Returns, defects, remedies and refunds
Returns, exchanges, cancellations and refunds are governed by the separate Return, Exchange, Cancellation & Refund Policy. A product described as non-returnable or final sale is non-returnable for ordinary change of mind; that label does not eliminate a lawful remedy for a genuine defect, material transit damage, wrong product, material non-conformity, spurious goods or any other matter for which Applicable Law provides a remedy.
16. Pre-dispatch quality assurance and evidence
TT may maintain order-specific quality records, including photographs or video of the product, tags, components, key measurements/customisations, packaging and sealing immediately before dispatch. These records are used for quality control, fraud prevention, complaint investigation and dispute resolution and are handled under the Privacy Policy. They may be considered as evidence but do not override a non-waivable legal right.
17. Product care, alteration and post-delivery modification
The Customer should follow the care label and any product-specific instructions. Damage caused after delivery by misuse, improper storage, unauthorised repair, third-party alteration, incorrect washing/dry-cleaning or ordinary wear and tear is not a manufacturing defect. Where an alteration by a third party makes it impossible to determine the original condition, TT may reasonably limit the remedy to the extent the alteration caused or obscured the issue, subject to Applicable Law.
18. Promotions, vouchers, store credit and gifts
Promotions, vouchers, gift cards and store credits may carry campaign-specific validity, eligibility, single-use or product restrictions disclosed before use. No promotional condition will replace a refund where Applicable Law requires a refund. Where a free gift or bundle benefit was conditional on a minimum purchase and a discretionary return takes the retained purchase below that threshold, TT may require the unused gift to be returned or adjust the discretionary credit to the extent clearly disclosed and lawful.
19. Website use and intellectual property
All Website content, including trademarks, trade names, photographs, product designs, copy, graphics, videos, software and databases, is owned by or licensed to TT and protected by Applicable Law. You may use the Website for lawful personal shopping. You must not scrape, reproduce, reverse-engineer, commercially exploit, impersonate, introduce malicious code, interfere with security or use the Website for unlawful or infringing activity without authorisation.
20. Reviews, communications and customer-provided content
If the Website permits reviews, photographs or other customer content, you warrant that you have the right to submit it and that it is not unlawful, defamatory, misleading or infringing. To the extent necessary to display and moderate the submission, you grant TT a non-exclusive, worldwide, royalty-free licence to host, reproduce and display it. TT may remove content that violates law, these Terms or platform standards, but will not manipulate reviews to mislead consumers.
21. Third-party services and external links
The Website may use or link to third-party payment, logistics, analytics, social-media or other services. Independent third-party websites have their own terms. This clause does not reduce TT's own obligations for the transaction or for service providers to the extent Applicable Law makes TT responsible.
22. Disclaimers and limitation of liability
To the maximum extent permitted by law, TT does not warrant uninterrupted or error-free Website operation and is not liable for remote, indirect or consequential loss arising solely from Website use where such loss was not reasonably foreseeable or is lawfully excludable. For ordinary contractual claims relating to a particular product or Order, TT's aggregate liability will, to the maximum extent permitted by law, not exceed the amount paid for the affected product/Order.
Nothing in these Terms excludes or limits liability or remedies that cannot be excluded, including applicable consumer/product-liability rights, fraud, wilful misconduct, privacy/data obligations or any other liability that Applicable Law prohibits TT from excluding or limiting.
23. Customer indemnity
You agree to indemnify TT against third-party claims and reasonable losses arising directly from your fraud, unlawful use of the Website, infringement of third-party intellectual-property rights through content supplied by you, or material breach of these Terms. This indemnity does not make you responsible for TT's own breach, a manufacturing defect, or loss for which TT is legally responsible.
24. Force majeure
TT will not be liable for delay or failure to perform to the extent directly caused by an event beyond its reasonable control that could not reasonably be prevented or overcome, including natural disaster, war, terrorism, riot, epidemic restrictions, governmental action, widespread transport disruption, strike not confined to TT, material customs/port disruption or failure of critical infrastructure. TT will use reasonable efforts to mitigate and communicate material delay. This clause does not displace any refund or other remedy that Applicable Law makes mandatory in the circumstances.
25. Privacy and electronic communications
Personal data is handled under the Privacy Policy. Transactional communications may be sent electronically using contact details supplied with the Order. Promotional communications will be subject to the applicable consent/opt-out framework. Electronic acceptance and records have the effect given to them under Applicable Law.
26. Consumer grievance redressal
Customer Care: [care@taruntahiliani.com] | [CUSTOMER CARE PHONE/WHATSAPP - 8448906622]. Consumer Grievance Officer: [Sonali Tayal], [Chief Financial Officer], [EMAIL: sonali.tayal@abfrl.adityabirla.com], [PHONE: +91 9990202182]. TT will maintain a complaint ticket/reference and, where the Consumer Protection (E-Commerce) Rules apply, will endeavour to acknowledge a consumer complaint within 48 hours and redress it within one month from receipt, subject to the nature of the complaint and Applicable Law.
27. Governing law and dispute resolution
These Terms are governed by the laws of India. Nothing in these Terms restricts a consumer from approaching a consumer commission, regulator, authority or court having jurisdiction under mandatory law. Subject to those statutory rights, disputes not falling within a mandatory forum may be brought before courts of competent jurisdiction having a legally recognised connection with the dispute, including the courts at Gurugram where jurisdiction otherwise exists.
28. Changes, severability, waiver, assignment and entire agreement
TT may update these Terms prospectively for legal, operational or service changes. The effective date/version will be displayed. A material update will not retrospectively reduce rights attaching to an Order already accepted, except where a change in law requires otherwise. If any provision is invalid or unenforceable, it will be read down or severed to the minimum extent necessary and the remainder will continue. Failure to enforce a provision once is not a waiver. TT may assign its rights and obligations as part of a lawful corporate restructuring/business transfer, subject to continuity of consumer rights. The Order Confirmation, these Terms and the incorporated policies form the agreement for the relevant online Order, subject to non-waivable rights under law.
